Kota Tangerang – Kementerian Hukum dan Hak Asasi Manusia (Kemenkumham) terpaksa kuasai pasar babakan, Cikokol, Kota Tangerang, dengan dasar mengedepankan kepentingan para pedagang dan Negara. Kendati demikian, PT. Griyatama Pancakarya selaku pengelola saat ini enggan angkat kaki dan menunggu putusan pengadilan.

Sis Nugraha, pengelola dari PT. Griyatama Pancakarya menyatakan pihaknya akan tetap bertahan menunggu putusan pengadilan yang telah dilayangkan kuasa hukumnya ke Pengadilan Negeri (PN) Tangerang.

“Kami sudah laporkan/gugatan ke PN melalui kuasa hukum kami. Sekarang tinggal kita tunggu proses hukumnya,” kata Sis Nugraha, Jum’at 25 Juni 2021.

Ia pun mengklaim, para pedagang pasar yang selama ini sudah berjualan di pasar babakan berdiri di belakang dan siap membela PT. Griyatama Pancakarya.

“Alhamdulillah pasar tetap kondusif tidak terpengaruh terhadap pedagang. Bahkan pedagang siap mendukung ke pengelola pasar yang sedang berjalan karena merasa ada kedekatan, nyaman aman dan kondusif, serta siap diundang kapan aja kalau dibutuhkan sebagai rasa solideritas,” ujarnya.

Sis Nugraha, penanggung jawab PT. Griyatama Pancakarya, pengelola pasar babakan, Kota Tangerang.

Sis Nugraha juga menepis bahwa pihaknya melakukan kerugian terhadap Negara. Menurutnya, selama ini PT. Griyatama Pancakarya mengelola pasar babakan dengan sistem pinjam – pakai dari Pemerintah Kota (Pemkot) Tangerang. Bukan sewa antara Swasta dengan Pemerintah.

“Sekarang kalau ada kerugian negara, saya tidak tahu konsekuensi pinjam pakai itu. Karena itu G to G, (Government to Government) itu adalah pinjam pakai,” tutur Sis.

“Tapi kalau misalnya kami nyewa ke kemenkumham dan terus saya tidak bayar, ini jadi kerugian negara. Ada gak diperjanjian itu saya, gak ada dong. Kewajiban yang mana yang tidak saya bayar? Karena kami disini adalah dititipin,” tambahnya.

Sebelumnya, Kemenkumham mengambil alih pengelolaan Pasar Babakan dengan menyegel dan memasang spanduk peringatan keras atas rekomendasi dari Badan Pemeriksa Keuangan (BPK) Republik Indonesia (RI).

Kemenkumham menilai, seharusnya ada peluang masuknya kas Negara dari pengelolaan pasar yang berlokasi di jalan Perintis Kemerdekaan itu. Namun selama ini tidak pernah dibayarkan. Apalagi dikelola oleh pihak Swasta.

“Itu dimulai berdirinya pasar ini tidak ada PNBP-nya ke negara. Sehingga ada temuan dari BPK itulah yang harus kita tindak lanjuti,” kata Gunawan seusai melakukan penyegelan di kantor pasar Babakan, Rabu 23 Juni 2021.

Hingga saat ini, meskipun telah disegel oleh Kemenkumham, aktivitas di pasar babakan masih berjalan normal seperti biasanya.
