Jakarta – Koalisi Aksi Menyelamatkan Indonesia (KAMI) mendatangi gedung DPR RI untuk menggugat berbagai bentuk penjajahan TKA China pada Industri Mineral Nasional pada Jum’at, 27 Mei 2021.

KAMI menyebutkan terkait TKA Cina ditemukan banyak masalah yang melanggar hukum, merugikan negara dan merampas hak rakyat untuk bekerja. Meski sudah digugat berbagai kalangan, termasuk Ombudsman, Anggota DPR, serikat pekerja, pakar-pakar, pengurus partai dan ormas, namun masalah Tenaga Kerja asal Negeri tirai bambu tetap berjalan lancar tanpa perbaikan, sanksi ataupun tersentuh hukum.

Menurut Komite Sumber Daya Alam (SDA) dan Lingkungan Hidup (LH) KAMI, Marwan Batubara, bahwa TKI Cina mendapat perlindungan serta jaminan dari berbagai unsur termasuk Oligarki dan Penguasa.

“Para TKA China seolah mendapat perlindungan dan jaminan dari oknum-oknum tertentu, termasuk oligarki penguasa-pengusaha. Mereka mendapat berbagai pengecualian, fasilitas dan kemudahan antara lain dengan dalih sebagai penarik investasi/FDI, penggerak ekonomi nasional dan daerah, serta status sebagai proyek strategis nasional (PSN),” Kata Marwan, dikutip infomassa dari keterangan tertulisnya, Kamis, 27 Mei 2021.

Ia menerangkan bahwa banyak pelanggaran yang dilakukan oleh TKA Cina, namun tidak ada langkah korektif dan sanksi hukum yang jelas dan berujung.

“TKA China melanggar berbagai peraturan yang berlaku, seperti UU No.13/2013 tentang Ketenagakerjaan, Permen Ketenagakerjaan No.10/2018 tentang Tata Cara Penggunaan TKA, Kepmen Tenaga Kerja No.228/2019 tentang Jabatan Tertentu oleh TKA, dan UU No.6/2011 tentang Keimigrasian,” Tambahnya.

Sedikitnya ada tiga poin utama yang menjadi tuntutan KAMI kepada Pemerintah, diantaranya:

  1. Menuntut pemerintah dan lembaga negara terkait untuk melakukan audit terhadap VDNI, OSS dan seluruh perusahaan China yang mempekerjakan TKA China di Indonesia;
  2. Menuntut pemerintah dan lembaga-lembaga terkait untuk memproses pelanggaran hukum para TKA China dan seluruh perusaahaan yang mempekerjakan mereka karena melanggar Pasal 63 ayat 2 dan 3, serta Pasal 122 huruf a dan b UU No.6/2011 tentang Keimigrasian;
  3. Dalam konteks pertahanan dan ketahanan nasional, menuntut pemerintah dan DPR untuk mengawasi dan menjamin terhindarnya negara dari ancaman rekayasa sistemik militer dan geopolitik China.
