Jakarta – Liga Mahasiswa Nasional untuk Demokrasi (LMND) Eksekutif Wilayah (EW) DKI Jakarta menilai bahwa pengesahan Rancangan Undang-undang (RUU) Penghapusan Kekerasan Seksual (P-KS) bersifat Urgent.

Nasaruddin Latupono, Ketua LMND EW Jakarta menjelaskan, terdapat perbedaan antara RUU P-KS dengan Kitab Undang-undang Hukum Pidana (KUHP) yang mengatur tindak pidana umum sebagai bagian dari hukum positif yang berlaku di Indonesia.

“Bahwa pengaturan KUHP yang mengatur terhadap kekerasan seksual sangat terbatas dengan dua bentuk, yaitu perkosaan dan pencabulan yang belum sepenuhnya menjamin dan memberikan perlindungan terhadap korban kekerasan seksual,” ujar Nasaruddin kepada infomassa.com, Kamis 11 Maret 2021.

“Tidak terciptanya efek jera bagi pelaku kejahatan. banyak kasus kekerasan seksual tidak berspektif dari korban dan kurangnya instrumen hukum yang mampu menyelesaikan setiap kasus,” ucap Nasaruddin.

Lebih jauh ia menyebutkan, bahwa hukum yang berlaku saat ini belum memberikan jaminan pemulihan terhadap hak korban dan keluarga. sebagai contoh, kata Nasaruddin, UU perlindungan anak hanya dapat melindungi anak yang menjadi korban kekerasan seksual.
